4.4 Trade Marks. “GamblerWall” and associated logos and branding are trade-marks of GamblerWall.com. Nothing in these Terms grants you any right to use our trade-marks without our prior written consent.

11. Governing Law and Dispute Resolution

11.1 These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which GamblerWall.com is registered and operated, without regard to its conflict of law provisions.

11.2 Any dispute arising under or in connection with these Terms shall first be subject to good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts of competent jurisdiction in the applicable governing jurisdiction.

11.3 Class Action Waiver. To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Severability

12.1 If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.

13. Entire Agreement

13.1 These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and GamblerWall.com with respect to your use of the Site and supersede all prior and contemporaneous agreements, representations, and understandings relating to the same subject matter.

14. Waiver

14.1 No failure or delay by GamblerWall.com in exercising any right, power, or privilege under these Terms shall operate as a waiver of that right. No single or partial exercise of any right shall preclude any further exercise of that right or the exercise of any other right.
